Welcome to NVRSClub. The terms "we", "us" and "our" refer to NVRSClub. NVRSClub operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). NVRSClub is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province, state or jurisdiction of residence.
To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information.
You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account.
SECTION 2 - OUR PRODUCTS
We make reasonable efforts to accurately represent the products offered through our online store. However, colours and product appearance may vary depending on your device, display settings and lighting conditions.
Many products offered by NVRSClub are pre-owned and may exhibit characteristics or signs of previous use. The condition, characteristics, year, included accessories and packaging of each piece may vary.
Customers are responsible for reviewing all available product descriptions, photographs and disclosed condition information prior to purchase.
All pre-owned luxury goods sold by NVRSClub are subject to authentication and inspection prior to fulfillment.
NVRSClub is an independent reseller and is not affiliated with, endorsed by, sponsored by or authorized by Hermès, Chanel, Louis Vuitton, Dior or any other designer or brand whose products may appear on our website.
All trademarks and brand names are the property of their respective owners and are used solely for the purpose of identifying authentic products offered for resale.
Product descriptions may be updated or corrected at any time. We reserve the right to discontinue any product or limit quantities offered to any person, geographic region or jurisdiction.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase.
NVRSClub reserves the right to accept, decline or cancel an order where reasonably necessary, including where an item is unavailable, does not pass authentication or inspection, contains a material listing or pricing error, or where we reasonably suspect fraud, unauthorized payment or other irregular activity.
Your order is not considered accepted until NVRSClub confirms acceptance and payment has been successfully processed.
If an order is cancelled after payment has been processed, applicable amounts paid will be refunded to the original payment method.
Please review your order carefully before submitting it. Once an order has been accepted and processing has begun, cancellation requests may not be accommodated.
If we decline, modify or cancel an order, we will attempt to notify you using the email address, billing information or telephone number provided with the order.
Purchases are subject to our Return & Refund Policy.
SECTION 4 - PRICES AND BILLING
All prices displayed on the NVRSClub website are shown in the currency indicated on the website.
Prices are subject to change without notice.
The price charged will be the price displayed at the time the order is placed, subject to correction of obvious or material pricing errors.
Unless otherwise expressly stated, displayed prices may not include applicable taxes, shipping charges, customs duties or import fees.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases.
You represent and warrant that you are authorized to use the payment method provided and that all payment information supplied is accurate.
For security purposes, high-value transactions may be subject to additional payment or identity verification prior to fulfillment.
SECTION 5 - SHIPPING AND DELIVERY
All NVRSClub orders are carefully inspected, authenticated and securely prepared prior to shipment.
Please allow up to 7 business days for order processing prior to dispatch. This period allows for authentication, inspection and preparation of each piece.
In exceptional circumstances, additional processing time may be required. If a material delay occurs, we will attempt to contact the customer.
High-value orders are shipped using tracked and insured delivery with signature confirmation where available. A signature may be required upon delivery.
Customers are responsible for providing a complete and accurate shipping address at checkout. Once an order has been dispatched, changes to the delivery address may not be possible.
Delivery estimates provided by NVRSClub or a shipping carrier are estimates and are not guaranteed. NVRSClub is not responsible for delays caused by carriers, customs processing or circumstances outside our reasonable control.
For international orders, applicable duties, taxes, brokerage fees and customs charges are the responsibility of the recipient unless otherwise stated at checkout.
If a package arrives visibly damaged, customers should photograph the exterior packaging before opening it and contact nvrsclub@gmail.com within 48 hours of delivery.
SECTION 6 - RETURNS AND REFUNDS
Due to the nature and value of our pre-owned luxury pieces, all sales are final once an item has been authenticated and approved for fulfillment, except where otherwise required by applicable law or expressly provided under this policy.
Each piece is carefully inspected and its condition documented prior to shipment. As pre-owned items may exhibit natural signs of wear, customers are encouraged to review all available product details before purchasing.
If an order arrives damaged or materially different from its documented condition, the customer must contact NVRSClub at nvrsclub@gmail.com within 48 hours of delivery.
Claims submitted outside this period may not be eligible for return, subject to applicable law.
If a return is authorized, the item must be returned according to the instructions provided by NVRSClub and in the same condition in which it was received, with all accompanying accessories, packaging, documentation, tags and security devices intact.
All returned items are subject to inspection and authentication before a refund is approved.
NVRSClub may verify identifying characteristics, authentication records, serial or date information where applicable, security devices, condition documentation, photographs and other records associated with the original item to confirm that the returned piece is the same piece originally shipped.
A refund will be issued to the original payment method after the returned item has been received and successfully verified.
Items that have been substituted, altered, used beyond what is reasonably necessary to inspect the item, damaged after delivery, or returned with removed or tampered security devices may be refused a refund where permitted by applicable law.
NVRSClub does not accept returns solely for change of mind, sizing, colour preference or characteristics consistent with the disclosed pre-owned condition of an item, except where otherwise required by applicable law.
SECTION 7 - INTELLECTUAL PROPERTY
The NVRSClub website and its original content, branding, graphics, designs, text, photography and other materials owned by NVRSClub are protected by applicable intellectual property laws.
You may use the Services for personal and non-commercial purposes only.
You may not reproduce, distribute, modify, republish, sell or commercially exploit NVRSClub-owned content without prior written permission.
NVRSClub names, logos, designs and slogans may not be used without authorization.
Third-party designer names, trademarks and logos displayed in connection with products remain the property of their respective owners.
SECTION 8 - THIRD-PARTY SERVICES AND LINKS
The Services may provide access to third-party tools, services, payment processors, shipping providers or websites.
NVRSClub does not control and is not responsible for third-party websites, services or content.
Your use of third-party services may be subject to separate terms and policies established by those third parties.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
NVRSClub is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and NVRSClub.
Shopify is not the seller of products offered by NVRSClub and is not responsible for the products purchased from NVRSClub.
SECTION 10 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, certain personal information may also be processed by Shopify and other service providers necessary to operate our store, process transactions and provide the Services.
SECTION 11 - FEEDBACK AND REVIEWS
If you submit reviews, photographs, feedback, suggestions or other content to NVRSClub, you represent that you have the necessary rights to provide that content.
You grant NVRSClub a non-exclusive, worldwide, royalty-free right to use, reproduce and display submitted feedback or reviews for purposes including operating, improving and promoting the Services, subject to applicable law.
You may not submit unlawful, misleading, defamatory, infringing or malicious content.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, condition, pricing, availability, shipping charges or delivery estimates.
NVRSClub reserves the right to correct errors, inaccuracies or omissions and to update information where reasonably necessary.
If a material error affects an order that has already been placed, NVRSClub may cancel the affected order and refund applicable amounts paid to the original payment method.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to violate applicable laws, infringe intellectual property rights, transmit malicious software, engage in fraud, provide false or misleading information, impersonate another person, interfere with the security or operation of the Services, or engage in conduct that may harm NVRSClub or other users.
We reserve the right to suspend or terminate access to the Services where we reasonably determine these Terms have been violated.
SECTION 14 - TERMINATION
NVRSClub may suspend or terminate access to the Services where reasonably necessary, including for violations of these Terms, suspected fraud, abuse or unlawful activity.
Any provisions that by their nature should survive termination will continue to apply.
SECTION 15 - DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
Nothing in these Terms excludes, restricts or modifies any warranty, condition, right or remedy that cannot lawfully be excluded under applicable consumer protection law.
SECTION 16 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, NVRSClub and its officers, employees, contractors, agents and service providers will not be liable for indirect, incidental, special or consequential damages arising from use of the Services.
Nothing in these Terms limits liability or consumer rights where such limitation is prohibited by applicable law.
SECTION 17 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless NVRSClub and its officers, employees, contractors, agents and service providers from third-party claims arising from your unlawful use of the Services, your material breach of these Terms or your violation of the rights of another person.
SECTION 18 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.
The remaining provisions will remain valid and enforceable.
SECTION 19 - WAIVER AND ENTIRE AGREEMENT
Failure by NVRSClub to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms, together with policies incorporated by reference, constitute the agreement governing your use of the Services.
SECTION 20 - ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without prior written consent from NVRSClub.
NVRSClub may assign its rights and obligations as permitted by applicable law.
SECTION 21 - GOVERNING LAW
These Terms of Service and any separate agreements through which NVRSClub provides Services are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to applicable consumer protection laws, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of British Columbia, Canada.
SECTION 22 - CHANGES TO THESE TERMS
NVRSClub may update these Terms from time to time by posting an updated version on our website.
Where required by applicable law, notice of material changes will be provided.
Your continued use of the Services following the effective date of updated Terms constitutes acceptance of those changes to the extent permitted by law.
